RETAIL SERVICE TERMS

Certain products or items ("Products") sold through notomorrowathletics.com/apparel (the "Site") may be available exclusively online, in limited quantities, and may be produced only after an order is placed. Products are subject to return or exchange only in accordance with our Return Policy.

 

PRODUCT INFORMATION

We make every effort to display our Products accurately through photographs, descriptions, and other information on the Site, but we cannot guarantee that your device's display will exactly match the physical product. Apparel Products are manufactured and fulfilled by a third-party production partner on our behalf, and minor variations in color, print placement, sizing, or fabric may occur between production runs. We do not guarantee the accuracy of photographs, descriptions, or other information on the Site.

If an error occurs in a Product description, an order confirmation, or in processing or fulfilling an order, we reserve the right to correct the error and revise your order accordingly (including adjusting the price) or to cancel the order and issue a full or partial refund. Your sole and exclusive remedy in any such case is a refund of the amount you paid for the affected Product, excluding shipping and handling fees.

 

PRICES

All prices on the Site are shown in U.S. Dollars. Applicable shipping and handling costs, taxes, and other charges are additional unless otherwise stated. We collect sales and use tax on orders shipped to jurisdictions where we are required to do so. Prices, discounts, and promotions are subject to change without notice. The price charged is the price in effect at the time your order is placed, as reflected in your order confirmation email. These Retail Service Terms, together with our Terms of Use and Privacy Policy, are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Essex County, New Jersey, and you irrevocably consent to the personal jurisdiction of those courts.

These Retail Service Terms, together with our Privacy Policy, our Terms of Use, and any other terms made available in connection with your use of the Site, constitute the complete and exclusive agreement between you and No Tomorrow Apparel, LLC, and supersede all prior proposals, agreements, or communications on the subject. Our failure to enforce any provision does not waive that provision or any other. Any waiver is effective only if in writing and signed by an authorized representative of No Tomorrow Apparel, LLC. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect. We may assign our rights and obligations under these Terms at any time without notice to you. You may not assign these Terms without our prior written consent.
